Do ETF’s Need More Regulation?

ETF’s have many benefits as I have stated here many times. To mention a few:
* That ETFs are generally much more tax efficient than mutual funds.
* That ETFs are generally less expensive than mutual funds.
* That ETFs are always more transparent than mutual funds.

But what is your opinion? Do ETF’s need more regulations? A Current regulation prevents mutual funds from acquiring more than 3% of any other fund, however a pending rule submission would significantly liberalize that 3% limitation. This change would allow mutual funds to invest in ETFs in a much easier way than now.
